Recreational Marijuana
This page is intended to provide factual information about the purchase and use of recreational marijuana in Colorado Springs and the state of Colorado.
What is Amendment 64?
Amendment 64 makes the private use, and limited possession (up to one ounce) and home-growing (up to six plants) of marijuana legal under Colorado law for adults 21 years of age and older. The law also established a system in which marijuana is regulated, taxed, and distributed similarly to alcohol. The law went into effect on January 1, 2014. The state government’s website has links to various national resources and will be adding additional information over time.
How might the law impact the Colorado visitor experience?
Statement from the Colorado Tourism Office: It is not yet known what impact – if any – the law will have on tourism. The law applies to both residents and visitors to the state. However, it is very important to note that Amendment 64 specifically bans public consumption of marijuana and using it in public remains illegal. The law will be fully enforced. Public areas include, but are not limited to, all public areas in business and residential areas, ski areas and resorts, federal land, public parks and sidewalks, state and national parks, and all public lands.
Does Colorado Springs have marijuana retail stores?
Many cities and counties within Colorado have chosen not to allow the retail sale of marijuana within their jurisdiction’s limits. This includes Colorado Springs and El Paso County as well as Teller County.
What about nearby towns & counties?
Manitou Springs has two retail stores. Pueblo has several outlets as well. You may not purchase recreational marijuana in Teller County (includes Victor and Cripple Creek) or Fremont County (includes Canon City). We recommend reaching out to each municipality for more detailed information.
Do area lodging properties allow usage in smoking rooms?
While area lodging properties are all private property and have the choice to allow usage at their own discretion, many area lodging properties have decided to ban all marijuana usage on the property. Please make sure you understand each properties guidelines and restrictions before booking or staying in an area room.
Can I transport purchased marijuana through the Colorado Springs or Denver International Airports?
No, it is illegal to transport or possess marijuana in both airports as well as across state lines.
Please keep in mind:
- The manufacture, sales and possession of marijuana is still a federal offense
- Communities and counties can and have chosen to ban recreational marijuana retail stores in their respective jurisdictions
- You may not buy, possess or smoke marijuana if you are under the age of 21; giving or selling marijuana to anyone under the age of 21 is illegal
- You may not consume marijuana in public and must have permission to do so if on private property
- DUI laws apply to marijuana
- Smoking laws and regulations also apply to smoking marijuana
- Out-of-state visitors are limited to purchasing up to one ounce (must be over the age of 21 with a valid photo ID)
